| SUMMARY EXPLANATION: | | The Yakima Municipal Code Chapter 8.72.040 currently requires, as a condition of obtaining a permit to excavate the public right-of-way, that contractors indemnify the City for any negligent act or omission in connection with their excavation. The proposed change to YMC 8.72.040 would modify the indemnification to harmonize it with the indemnification language contained in other sections of the YMC, and it would broaden contractors’ indemnification obligation to cover all claims arising out of any act or omission in connection with excavating the public right-of-way. |
