| | | | | | | | ITEM TITLE: | Ordinance amending the City of Yakima Municipal Code Chapter 8.20 Right-of-Way Use Permits | SUBMITTED BY: | Sara Watkins, Senior Assistant City Attorney |
SUMMARY EXPLANATION: | Currently the Planning Division takes applications for right-of-way use permits, but Engineering also issues some short term right-of-way use permits. Additionally, the FCC has adopted regulations that require municipalities to process applications for small cell facilities in rights-of-way in an expedited manner with little ability to create local regulations. As a result, staff proposes an amendment to the right-of-way use ordinance that contemplates short-term right-of-way use permits, small cell facility applications, and makes additional changes to the ordinance that allows the City to efficiently and effectively provide permits for uses within the right-of-way, and enforcement of those permits. Staff also proposes an increase to the fee, which has not been increased since 2009, from $50.00 to $100.00. Short-term permits (good for up to 30 days) would have a $50.00 fee under the proposed ordinance language. |
