In November of 1993 the voters of the City approved Ordinance No. 93-86, thereby granting Nob Hill Water Association a twenty five year franchise to construct, operate and maintain a water distribution system within those areas of the City described and depicted in the Exhibits attached to the Ordinance presented herein.
During the years since the franchise was granted Nob Hill Water Association has developed significant water delivery infrastructure, providing water to most of the west side of the City. The term of the 1993 Franchise will expire in December of 2018, necessitating a renewal of the expiring agreement. The City and officials of Nob Hill Water Association have worked for the past year to review, revise and generally update the terms of the franchise agreement to reflect the current codes and operating standards that now exist in the City. The City is compensated by Nob Hill Water Association by receipt of 2% of Nob Hill’s gross annual income from water sales under the franchise terms.
The attached and incorporated Ordinance granting a franchise to Nob Hill Water Association has been approved by the Association’s Board and has been reviewed by City staff, and is now ready for Council consideration. If approved during the October 16 City Council meeting, the Ordinance will become effective on November 19, 2018, providing the terms of Nob Hill Water Association’s continued operation within the City over the next twenty five years. |
