The City of Yakima (City) is a direct bebeficiary of the Kachess Dam and the Yakima Project which provides irrigation water to the City and throughout the Yakima Valley. As a beneficiary of the Project and under the Reclamation Safety of Dams Act of 1978, the City is required to pay its proportionate share of construction and other costs associated with maintaining the dams in safe condition. On August 2, 2022, the City signed Contract No. 22SD102178 (Contract), with the United States of America Bureau of Reclamation (USBOR) for the repayment of Kachess Dam Safety of Dams (SOD) modification costs.
On May 23, 2023, the City received the Notice of Execution of Contract, along with a proposed amendment to the Contract. As a result of negotiations with some of the other contractors for the SOD repayment contracts, a clause in Article 9 (Statement of Costs) was revised to language they favored. City Legal has reviewed and accepts the amended language.
